The Foreign Affairs, Defense and National Security Committee is studying a proposal for a law to add a new article No. 351 bis to the Penal Code issued by Decree Law No. 15 of 1976.
The article to be added stipulates that “imprisonment for a period not exceeding one year and a fine not exceeding one thousand dinars or one of these two penalties is punished with a woman’s uniform, or entered a place for women or prohibited to enter it for non -women, and if he commits a crime in this case, this is a strict circumstance.”
The explanatory note indicated that some males resort to denial of women’s uniforms to be found between them and see what is not to be seen, but the spread of modern means of communication has increased from the possibility of some of these means to attack the privacy of women and an attempt to blackmail them by disguise and the use of these means, which has a devastating effect on families and society because of this type of male who finds in disguise a way to facilitate the violation of the rules of privacy And the sanctity of the councils of women who are predominant and preserved to protect the authentic values of society and its established traditions.
Hence the proposal of a law to represent a deterrent to these cases, and even considered a strict adverb to use a means of committing a crime, and this amendment comes as a preservation of women and a protection for its sanctity that the constitution is keen on, and some comparative legislation criminalized disguise in a woman’s uniform or subjugation and entry surreptitiously to the places designated for women such as Emirati legislation in the law of crimes and penalties issued by a decree of a law No. 36 of 2022, which was presented in Article (412) for these actions by criminalization and heavy punishment.
This proposal has taken into account the law of the principle of uniqueness of the punishment, so that the judge granted a discretionary authority that allows him to take into account the conditions of the crime so that the punishment is more deterrent, and the text will be achieved for its goals and objectives.
