Touq explained, in an interview with “Al -Watan”, that the presence of the lawyer does not mean justifying the action or underestimating the human tragedy, but rather aims to communicate the voice of the accused to the judiciary and ensure the application of justice in all its pillars, stressing that he dealt with the issue by dealing with all wisdom, strength and steadfastness in the face of these pressures and criticisms that he received through various social media, indicating that despite all the criticisms, he was keen to play his role with every professionalism and professionalism A session in the case. How did you receive the news of the Sar incident, and what prompted to take up this case?
– The beginning of the case, of course, was touched by every Bahraini citizen, it was a painful issue to everyone.
Certainly, I do not condemn or exclude or ignore human sorrow, but at the same time the lawyer must play his role with all professionalism and impartiality, in order to ensure the rights of the accused in providing the defense of any accused.
What are the initial challenges at the beginning of the case and the reactions you have faced personally as a lawyer?
– I do not call challenges, we can be able to use the term “pressure”, because all the Bahraini people and the Bahraini society were clear to him that the direction in this issue was a purely human motivation, “emotion only” without seeing the details of the issue or knowing its circumstances, because I dealt with this issue by dealing with all wisdom, strength and steadfastness in the face of these pressures and criticism that I received from various social media And professionalism until the last session in the case.
Were you expecting reactions, especially the appearance of your personal image in the news and widely circulating your name?
– We are generally as lawyers during our professional work throughout our experiences of experience, we are exposed to such situations, especially in the presence of sessions of opponents, so we understand society and its emotion and how to receive this news, or these issues, because I was expecting from the first day I received the case that I will face these criticisms and pressures in social media, so I was understanding; Because in the end it has human pain, and I was ready for it, and I dealt with it with wisdom and again.
As for your media appearance, is it possible for the lawyer to benefit from the intense media appearance?
– I believe that the primary goal or the desired result from the media appearing to any lawyer in issues of concern to public opinion is to spread legal awareness, as many criticisms and comments that came to me, we tried to respond to it in a way that society understands the role of the lawyer in achieving the legality of defense and the right of the accused to defend any kind of issues, and this is the right to defense is guaranteed to the constitution such as the right to housing, the right of health and the right to education, as well as the right to defense is guaranteed to the constitution, so On the type of case, the lawyer’s presence is a key pillar of justice; Because justice consists of three parties, a claim calling for the application of the right and the law, and a defense that transmits the accused’s point of view to the court, and focuses on confirming the guarantees guaranteed by the provisions of the law and an independent judicial authority that separates these two parties.
Such issues refer to the legal and humanitarian aspect that it is not permissible to defend a defendant who caused the death of an innocent family. What is justice in such issues?
– Firstly, from the legal point of view that every person is a litigant, whether he is accused or a victim, has the right to reach his voice to the judiciary, so the ordinary people may not have the possibility to communicate their voices clearly and use the texts of the law, so the role of the primary lawyer comes to communicate the right of the accused or the litigant, whatever its type to the judiciary, so that his voice is clear and audible for the application of the law It rules a ruling respected from all parties.
With the large number of evidence that was proven against the accused, is the defending of the accused as a defense of the crime?
– The presence of a lawyer who defends any accused does not mean justifying the crime, and does not mean accepting the act, and if the lawyer is in a session of the sessions, and the student of innocence does not seek innocence, except after the lawyer gets papers or bases that qualify him to request innocence in this case or other cases, and therefore the lawyer is governed by the case papers and evidence that he has.
The mother of the street or society does not have a knowledge of this issue, where everyone started speaking from his personal and emotional point of view in the first place without entering into the details of the case and knowing it, so the lawyer is in all his conditions, or in all cases if he recovers that he is in evidence, or in a specific incident in the call papers, he qualifies him to request innocence, so he will certainly demand that in order to ensure the achievement of justice and the achievement of legal texts, and in the end the ruling is due to the court.
Personally, you have been criticized from the Bahraini street, and there were many questions from people: “How does the heart of this lawy be tolerated by such a case? How does he sleep at night?
– Since the first day, and in previous cases and throughout my 20 -year experience in the law, I was criticized by the opponents, and by the people of the opponents, where we always hear abusive words that we are pleading with unjust people.
In the opinion of this, a limited point of view of its narrow angle, but the lawyer looks at the case from all parties, where he looks at the evidence of the accusation, and looks at the evidence of the accused’s sayings and the circumstances We are excused, and we are our role as lawyers, spreading awareness, and on my Instagram page, I published the role of the lawyer in defending the accused, even if it is a crime that society sees as a very great crime.
Do you think that some lawyers can be subjected to media and societal pressures that give them affected in some cases, and give up some of the issues that they are pleasant?
– The lawyer does not have the right to apologize for taking a case after what caught it because of the only media pressure or societal opinion. Because this is completely separated from the role of the lawyer, because its role is to achieve justice in the context of the law and the constitution, so the lawyer must separate the societal opinion and between his professional role as the defense profession.
Have you seen certain cases of lawyers where they were pressured, and gave up their issues?
– I have not seen cases, but some colleagues spoke to me, and they told me it is better to give up on this issue; Because the entire society will be against me, but I told them if I gave up and other lawyers abdicated his case, so where will the accused’s right to defense go?
This gives an impression to society that the issue went with transparency, and gives confidence to society that the rulings were issued in a fair and transparent manner, and therefore any lawyer who waives the pleasure of the existence of societal or media pressure was considered that he must review himself, and strengthen himself more, because the truth, the truth and the law must be stronger than the societal opinion that is taken or issued from human and emotional matters.
Have you seen a change in your personal life by treating people after taking the case?
– People to my district defected between two parts, a sympathetic section with the victims, and I am the first of them when I heard the news, as I told you any Bahraini citizen was humanly influenced by the news, and a second section was supporting me and supporting me and telling me Wasel, and I do not care about these negative comments; Because these negative comments are caused by a lack of legal awareness.
With clear and official evidence against the accused, how can the lawyer defend him, does he have to lie?
– This is one of the matters related to the case and it is not permissible to address and go into it. The evidence was presented before the court and the defense was presented by us and we discussed all evidence of evidence, and we presented what justifies our request for innocence, and the ruling in the end was issued and we respect the word of the judiciary.

A word or message that you like to send to the audience regarding this issue, or regarding the law in general?
– A general word that I want to direct to people from my comments, that it is important to have legal awareness, as the issue must be studied, and it is seen from the two or two sides, the side of the victim and the side of the accused, and we are in front of a state of law in which justice was established, and the foundations of the law exist in the text of the law.
In the law there are many guarantees for the accused that must be applied, and this is the role of the lawyer to be present to plead to ensure that the accused obtains all legal guarantee and the delivery of his voice to justice and the court, so the lawyer is the presence of any kind of cases, even if it was a case that shook public opinion, this does not contradict his professionalism and the moral of the lawyer, and does not challenge it.
