What is the difference between loan and financing? .. The fatwa is answering

The Secretary of the Fatwa at the Ifta House, during a dialogue with the media, Zainab Saad El -Din, on the “Fatwas of People” program, today, Wednesday, that this common description does not reflect the truth of the treatment that takes place, stressing that what is called a bank loan is mostly funding and not a loan in the jurisprudence.

Amin Al -Fatwa added: The difference between the loan and financing is very important, and this is to be determined in the second stage of the fatwa, which is the stage of air conditioning, because the transaction must be classified: Is it a loan? finance? a company? Speculation? mortgage? investment? All decades, and the lesson in contracts is not the words that are said, but the content.

Amin Al -Fatwa explained that the basic criterion on which the ruling is based is a great jurisprudential rule that says: The lesson in contracts with intentions and meanings, not by words and buildings, adding: I mean, someone can say so and so, so and so, so and so, so he hears it, so you hear it like this and says usury, but when we understand the process, we will discover that it is not a registration, this is speculation or investment, and they agreed on the percentage of profits.

The Secretary of the Fatwa pointed out that the lack of understanding of people to the details of the financial process may lead to a wrong judgment, adding: The lack of awareness or my lack of understanding of the treatment can completely change the judgment, and this is the reason that the mufti does not stop at the words but rather searches for the truth of dealing, and therefore I can say: This is a financing treatment that is not a usurious loan, because it does not correspond to the conditions of usury.

Is it permissible for the wife to visit her sick mother despite the husband’s refusal? .. Amin Al -Fatwa answers

Meanwhile, Dr. Mahmoud Shalaby, Secretary of the Fatwa at the Egyptian Ifta House, answered a question about a case of a woman who suffers from difficult material conditions and asks for financial help to travel to visit her sick mother with a serious illness, while her husband prevents her from traveling?

Amin Al -Fatwa said that the basic principle in the relationship between the spouses is understanding and consensus, especially in matters related to travel and the visit of the family, stressing that obedience to the husband is obligatory in a non -disobedience, but it should not be at the expense of mercy and humanity.

Amin Al -Fatwa added: The generous questioner came out of the help question to another question about obedience to the husband. Helping in itself is permissible and desirable as long as the person is in real need, and there is no relationship to the charity with the details of the life of this person.

Amin Al -Fatwa added that the wife must seek to understand with her husband about traveling and its timing, and deal with him with goodness, but if the husband refuses to intransigence without justification, and the mother is going through a critical health condition, the issue may turn into a state of necessity.

The Secretary of the Fatwa continued: In Islamic jurisprudence, it is necessary to permit the prohibited, and if the mother’s condition reaches a dangerous health situation, and her daughter’s presence is a necessary necessity, then the necessity is estimated by her amount, and the wife can then go taking into account the attempt to reconcile the consent of the husband and her mother’s righteousness.

He also sent a message to the husband, saying: It is not valid in such situations.

What is the ruling on hearing the Qur’an during sleep? .. The Secretary of the Fatwa answers

Dr. Mahmoud Shalaby, Secretary of the Fatwa at the Egyptian Ifta House, answered a question about the ruling on hearing the Qur’an during sleep?

He said: There is absolutely nothing wrong with the person leaving the Holy Qur’an working while he is asleep, for this is nothing in it legally, but it may be good, blessing and reassurance, because hearing the Qur’an has a tranquility and mercy.

He explained that the Almighty saying: {If the Qur’an is read, listen to it and listen to you, may you be merciful}, then some scholars explained that it is specific to the Friday sermon, and others said that it includes all the places of reading the Qur’an, but what is meant is the listening when listening if a person is present and devoted, but if he sleeps or is preoccupied, then there is no sin on him.

He emphasized that: The operation of the Qur’an during sleep is not embarrassed, but many people can sleep except on the sound of the Holy Qur’an because of its psychological comfort and tranquility, which is something that Sharia does not prevent and does not take a person.
