The Egyptian Fatwa House answered a question that read: What is the ruling on making up prayers that were neglected intentionally or by forgetfulness? A person was afflicted with intentional neglect of prayer for a period of time, and he repented to God Almighty and wanted to make up for the prayers he had missed. He asks about the ruling on making up for this prayer, and whether the ruling is different if he left it for an excuse. Asleep or forgetfulness?
The Egyptian Fatwa House said on its official website: Making up for the obligatory prayer that was missed is obligatory, whether it was missed with an excuse that did not invalidate it, or it was missed without an excuse, and the sin is not removed simply by making up for it, but rather repentance is required along with it, just as prayer is not canceled simply by repentance, for making up for it is obligatory. Because one of the conditions of repentance is abstinence from sin, and the one who repents without making up for it does not abstain from his sin.
Ruling on making up prayers that were intentionally missed
She continued: The jurists differed regarding prayers that were intentionally neglected. The scholar Ibn Baziza al-Maliki said in Rawdat al-Mustabin (1/374): [واختُلف في المتروك عمدًا، والجمهور على وجوب قضائها بعد التوبة والاستغفار] Oh.
She confirmed: The scholar Badr al-Din al-Ayni al-Hanafi said in “Al-Bina’ah Sharh al-Hidaya” (2/582, ed. Dar al-Kutub al-Ilmiyyah): [(ومن فاتته صلاة قضاها إذا ذكرها) سواء كان فوتها ناسيًا، أو بغير عذر النسيان أو عامدًا، وبه قال مالك والشافعي، وقال أحمد وابن حبيب: لا يقضي المتعمد في الترك] Oh.
She explained: Rather, the majority said that prayers that were neglected intentionally should be made up; By analogy with alerting the lowest over the highest; The Messenger of God, may God’s prayers and peace be upon him and his family, drew attention to the forgotten prayer in what Imam al-Bukhari narrated on the authority of our master Anas bin Malik, may God be pleased with him, that the Messenger of God, may God’s prayers and peace be upon him and his family, said: “Whoever forgets a prayer, let him pray when he remembers it, there is no expiation for it except that,” and it is less than that. The one who intentionally leaves it, the highest is included in the warning section First.
