The Legislative and Legal Affairs Committee of the Shura Council, headed by Attorney Dalal Jassim Al Zayed, discussed Decree Law No. (8) of 2024 AD ratifying and approving accession to 4 international treaties and agreements related to judicial affairs, and related to the establishment of the Bahrain International Commercial Court.
The treaties considered by the Committee include the Treaty on the Taking of Evidence Abroad in Civil or Commercial Matters, which was concluded in The Hague on March 18, 1970, which aims to facilitate and implement letters requesting the taking of evidence abroad and improve mutual judicial cooperation in civil or commercial matters, in addition to the Treaty on Selection of Court Agreements, which was concluded in The Hague on June 30, 2005, which aims to enhance judicial cooperation in order to support trade and investment through the application of unified rules regarding Jurisdiction, recognition and enforcement of foreign judgments in civil and commercial matters.
The members of the committee also reviewed the United Nations Convention on International Settlement Agreements Emerging from Mediation, signed on December 20, 2018, which aims to expand the use of mediation to settle disputes in a way that reduces the cases in which the dispute leads to the termination of the commercial relationship, facilitates international transactions by commercial parties, and provides more areas for achieving justice.
The fourth agreement within the Decree Law is the agreement between the Government of the Kingdom of Bahrain and the Government of Singapore regarding the appeal of rulings issued by the Bahrain International Commercial Court, signed on March 10, 2024, which aims to encourage the use of international dispute resolution methods in cross-border trade, which contributes to strengthening cross-border commercial justice, and enhances mutual cooperation between the Bahrain International Commercial Court and the Singapore International Commercial Court, which contributes to developing standards for resolving international commercial disputes.
