Representatives Khaled Bouak, Ahmed Al -Salloum and Hisham Al -Awadi revealed that they were submitted as a law to regulate the activity of food providing services with mobile vehicles prepared for that, which provide services in specific places “Vood Taraf”.

According to the proposal, the license is required to carry out the activity of food providing services with mobile vehicles, to be Bahraini, with the approval of the Ministry of Health, and the approval of the General Administration of Civil Defense at the Ministry of Interior.

The licensee must register the vehicle intended for use in the activity of providing food services with mobile vehicles with the General Traffic Department at the Ministry of Interior, and obtaining the approval of the competent municipality after coordination with the relevant authorities regarding the places specified for the vehicle parking, and taking into account not to prejudice the traffic safety rules.

The licensee must also write his commercial name and commercial registry number clearly on the vehicle used to carry out the service of providing food services in the vehicles transferred.

It is not permissible for the licensee to practice the activity of providing food services with mobile vehicles, to obtain fetch permits for foreign workers related to this activity.

The owner of the mobile vehicle, when practicing the activity of food providing services, is obligated to obtain written approval from the owner of the property before standing to practice the activity, not to stand the mobile vehicle within the street packages, that the mobile vehicle does not stand in front of the residential principles directly, leaving a distance of 50 meters between the mobile vehicle from any crossroads, roundabouts or light traffic lights, leaving a distance of no less than one meter between the mobile vehicle and other vehicles from all Trends, ensure the integrity of electrical connections (if any), maintain the cleanliness of the place and throw the waste in the designated places, adhere to the requirements of public safety and civil defense, and not cause noise pollution for neighboring buildings.

The owner of the mobile vehicle also obliges the number of activity in a real estate that falls within the residential classification with the availability of parking lots within the limits of the property, and practicing the activity within the time frame, from six in the morning until twelve at night, and not keeping the mobile vehicle in the residential area in times outside the timetable set above, and ensuring that no equipment or furniture is left in the residential area, and left a distance of no less than 20 A meter between vehicles and adjacent buildings from all directions, and it may also put an unstable wall, tables and seats in agreement with the property owner, and an electricity generator may be used, provided that it is of the silent type.

The owner of the mobile vehicle is obliged when practicing the activity in a property that falls within the non -residential classification to determine the period of practicing the activity and standing in the property in agreement with the owner of the property, and setting a wall, tables and seats that are not fixed in agreement with the owner of the property, and he may also build permanent facilities such as a wall, tables and seats under a building permit submitted in the name of the property owner after obtaining his written approval, provided that the construction takes place according to the regulatory requirements of reconstruction.

According to the proposal, the capital or the competent municipality must enable the licensee to the owner of the mobile vehicle to practice the activity in the areas owned by it or that falls under its administration, provided that it is distributed to all parts of the Kingdom according to specific controls and mechanisms, and that a license from the capital or the competent municipality be issued to carry the licensed data and the period of license, and the competent minister issues the executive regulations of this law within six months of the date of its publication in the official newspaper.

The explanatory note of the proposal indicated that it aims to organize the activity of providing food services with mobile vehicles, known as food carts, which is a rapidly growing phenomenon that is an integral part of the modern economic and social fabric, this organization aims to achieve a balance between supporting entrepreneurs and providing a healthy and safe environment for consumers and society as a whole, and the public interest of this law is revealed through several major aspects where it is healthy The consumer and his safety after a top priority, and Articles 2 and 6 of the law include this through the requirement for obtaining approvals from the Ministry of Health and the General Administration of Civil Defense, and adhering to the standards of hygiene and public safety, and this aims to prevent the spread of foods transmitted through food, and to ensure that the foods provided are compatible with the approved health standards, and protecting the public from any possible risks.

The proposal also deals with Article 3 and 6 Traffic Safety Cases and the regulation of mobile vehicles parking, by identifying the permitted places to park these vehicles, determining the distances that must be left from intersections, circles and traffic lights, traffic congestion is reduced, avoiding traffic, and reducing the risk of accidents, which is in the interest of all road users.

Articles 6 and 7 address the issue of maintaining general hygiene and preventing noise pollution, especially in residential areas with the aim of preserving the quality of life for the population, preventing distorting the urban appearance of cities, and ensuring a calm and comfortable environment for the neighbor This is prohibited from the licensee for obtaining permits to bring foreign workers to this activity, and these materials enhance the opportunities for Bahraini youth, encourage local entrepreneurship, and contribute to national economic development.

The proposal is required in Articles 6 and 9 to obtain the approval of the property owner before standing up to practice the activity. This procedure guarantees respect for private property rights, and prevents any violations or violations of these rights, as this law contributes to the involvement of the capital’s secretariat or the municipality specialized in enabling the owner of the vehicle traveling in the areas owned by it or that falls under its administration to be distributed to all parts of the Kingdom according to specific controls and mechanisms, and that it is obtained A license from the Capital Municipality or the competent municipality to bear the licensed data and the period of licensing, which also ensures the restriction and determination of spaces and respect for public property rights.

Through the requirement of registration of the vehicle and obtaining the necessary approvals, and clarifying the trade name and the commercial registry number on the vehicle of Articles 3 and 4), the law contributes to the regulation of the sector, facilitate the control process, and increase transparency, which enables the supervisory authorities to perform its role effectively and ensure that everyone adheres to the specific standards and controls.

The proposal takes into account the nature of the activity of mobile vehicles by identifying special controls and requirements to work in residential and non -residential properties (Articles 7 and 8), including identifying the permissible working hours in residential areas, the ability to place fences, tables and unstable seats, and the use of silent electricity generators, this flexibility allows activity to prosper while maintaining the privacy and comfort of the adjacent.

The proposal represents an essential step towards organizing this vital sector in a way that guarantees the safety and health of society, maintains public order, enhances the role of citizens in economic development, and protects the rights of all, so we emphasize the public interest inherent in the issuance of an independent law to regulate the activity of providing food services with mobile vehicles (Food Trucks), instead of continuing to rely on the ministerial decisions currently organized, and although the current decisions have contributed In organizing this activity, the transformation of these provisions into a law will be granted more legal and stability, due to the supreme legal status of the law compared to decisions.
