Sheikh Ahmed Wissam, Secretary of the Fatwa at the Egyptian Ifta House, answered a question received from a woman called Hoda from Alexandria, saying: My husband was bad with me, so I raised the issue of divorce and the court rejected it, and my family is the ones who spend on me and my three children, and I also raised the issue of expense and refused to return to the house .. Is this forbidden or permissible?

Wissam explained, during televised statements, that the issue is not in the context of the permissible and forbidden as much as it is a marital problem pending before the judiciary, as if the judge sees that the reasons that the wife presented are not sufficient to divorce the harm, and therefore she is still a wife legally and law, and she has the right to alimony for her husband.

He pointed out that the wife’s refusal to return the husband to her home also falls within the framework of marital problems, and not a direct legal ruling, but rather needs to be solved and included in the treatment as God Almighty commanded: the beginning of dialogue between the spouses, then by using the two rulings of his family and her family, if the dispute is referees and there is no way for reform, then divorce is a legitimate way out:

The Secretary of the Fatwa emphasized that the basic principle in such issues is to seek reform and search for a radical solution to the problem, instead of stopping when symptoms such as alimony or refusing to return to the house, so the disagreement of its roots is the most important.
