At a time when the risk of traffic is the opposite of the direction, the most urgent issues of the solution, it is, according to the head of the Traffic Prosecution, is a great traffic misdemeanor in Bahraini law, and his penalty may reach six months detention or a fine of up to 500 dinars.

8 cases of this kind have already been referred to the competent court this year alone.

Initially, how do you evaluate in the Traffic Prosecution how dangerous “traffic is the opposite of the direction”, and what is the legal nature of this violation in light of the results it may cause?

The traffic violation is the opposite of the direction of the most dangerous traffic violations, because of the direct threat to the lives of vehicle drivers and road users. And it is classified by Bahraini law as a massive traffic wings, and its penalty may reach imprisonment for a period not exceeding six months, or the fine that may amount to five hundred dinars, according to the circumstances of the incident and its consequences. The seriousness of this violation is that it is often a direct cause of severe incidents, as we have seen in some recent issues that have attracted public opinion.

Have this violation really linked to incidents that resulted in deaths in the last period?

– Yes, unfortunately, we witnessed traffic accidents in the last period in which severe violations were committed, such as the walk, the opposite of the direction and the transcendence of the legal speed, and these actions have claimed the lives of a number of people. Therefore, we give these issues a top priority in investigation and follow -up, and we deal with them as crimes that threaten public safety, and not just traffic violations.

What about the violation of the speed of the law? How do you see it legally and socially?

The legally prescribed speed is one of the most common behaviors that threaten public safety, as it represents a major factor in many serious incidents. Although this violation may appear simple on its face, it often leads to a loss of sudden control or collision. According to the law, a misdemeanor is punished with imprisonment or a fine, and the punishment is tightened if the violation is associated with serious results, such as injury or death.

Can you inform us about the number of cases related to these violations this year?

– The violating of the traffic is the opposite of the direction and the transcendence of the legal speed is among the most violations that we monitor continuously, especially when they cause accidents or appear in automated monitoring reports. During the current year, 8 cases related to the reversal of the direction were referred to the competent court, where investigations have proven that the defendants committed these violations in circumstances that pose a great risk to public safety.

What are the procedures that the Public Prosecution takes when controlling traffic crimes? Are there cases in which the punishment is tightened?

– Once the communication has been received, the Public Prosecution shall be initiated by the study of the incident in various aspects, and the records of collecting inferences, technical reports and digital evidence require, then begin to conduct the necessary investigations, especially in grave cases that involve an actual threat to the safety of lives or property. The prosecution shall take all the legal measures stipulated in the Traffic Law and the Criminal Procedure Law, including issuing arrest warrants, reserve imprisonment, and technical experts to check vehicles according to the case.

In the event that it is found that there is an adult danger or influential results caused by the violation, the accused is referred to the competent court, where the Public Prosecution plays its role in pleading, clarifying the aspects of evidence, and responding to the accused’s defenses or his lawyers.

Judicial rulings have already been issued by imprisonment between six months and two years, within the framework of the discretionary authority of the court, according to the gravity of the committed act. With regard to the tightening of the penalties, the traffic law and its executive regulations impose different degrees of punishment according to the amount of the violation. For example, if the driver does not exceed the prescribed speed by more than 30%, then the penalty is between 50 and 250 dinars, or imprisonment from one to three months.

But if the speed percentage exceeds 30%, the penalty rises to the fine ranges between 100 and 500 dinars, or imprisonment from one month to six months, and if the violation results, such as the walk in the opposite of the direction, or exceeding the prescribed speed, the death or injury to anyone, the punishment is more severe, where the provisions of the Penal Code are applied alongside the Traffic Law, which in some cases may reach imprisonment for ten years, according to the body’s body and the circumstances of the commission Crime.

Do you look at reckless leadership and obstruct traffic as minor violations or misdemeanors threatened with traffic security?

We do not look at it as minor violations, but rather deal with it according to the gravity of the committed behavior. If the reckless leadership or the obstruction of the traffic is endangered by lives or property, then it is a misdemeanor of accountability, and it may be referred to the court, especially if it results in harm.

In light of the diversity of traffic violations and the different levels of their risk, what is the legal criterion that you are based on in the prosecution to determine how to act in these violations?

We rely on the legal evaluation of the seriousness of the act and the circumstances and results of it. If the violation does not involve a great danger and does not result in effective damage or threat to the security of the road and the safety of users, then we issue a criminal order by signing a fine on the accused, according to what the law provides.

But if the incident carries severity elements, such as if they have caused severe damage, or constituted a serious threat to traffic security, or were within a series of repeated violations, then we are referring to the accused to the criminal court to take more severe measures, in proportion to the nature of the act and the degree of its risk.

Is it possible to provide us with a general statistic about the number of traffic issues during the current year?

– From the beginning of the year 2025 until the beginning of this month, the Traffic Prosecution has received about 2,300 traffic cases, which varied between accidents that resulted in deaths or error injuries, and damage accidents, as well as various violations such as overcoming speed, walking in the opposite direction, reckless change of the path, and bypassing traffic signals.

This relatively high number is due to the lack of commitment of some drivers to traffic rules, which requires the continued legal intervention to reduce these dangerous behaviors. – The Traffic Prosecution depends on an integrated electronic system that contributes to accelerating legal procedures and enhancing its efficiency, and one of its most prominent components is to link with the “Najm” system of the Ministry of Interior, which allows the accused to be summoned and their declaration directly and effectively.

The e -government database is also based on documenting transactions, in a way that contributes to reducing the time of litigation, and raising the levels of transparency and accuracy in the procedures. The Public Prosecution calls on citizens and residents to benefit from the available electronic services through its official website, such as requesting testimonies, providing grievances, and attaching agencies, as well as the possibility of paying fines through the e -government website with ease and safety.

The Traffic Prosecution is also one of the leading bodies in the application of the visual investigation technology, as this means depends on the interrogation of the accused and the hearing of witnesses from a distance, in a manner that guarantees speed and flexibility in the completion of cases, while maintaining the fair trial guarantees.

In traffic cases, digital evidence is often clear and direct, whether they are pictures or visual records of surveillance cameras or monitoring systems. We deal with it within a disciplined legal framework, taking into account privacy, ensuring the safety of procedures in terms of the source of the guide, the timing of obtaining it, and the legitimacy of its use.

Therefore, we do not face fundamental challenges in this aspect, because the Bahraini legal system has developed accurate controls to ensure a balance between the effectiveness of evidence and respect for individual rights.

What are the legal ways to appeal or grievance from the prosecution’s decisions, such as the criminal order or the decision to preserve? Is it subject to judicial oversight?

– Yes, the law guarantees the right to grievance from the decisions issued by the Public Prosecution, whether it is the criminal order to impose a fine, or the decision to keep the complaint. The defendant or the author of the authority has the right to make an objection to the criminal order or the grievance of any decision issued by the prosecution, in accordance with the legal procedures regulating this.
