The Higher Commercial Appeals Court in Bahrain issued a final ruling to compel a hotel services company to pay the amount of 4140 dinars to a Gulf company that contracted with it, after the hotel services company had failed to implement its complete contractual obligations, despite its collection of 25 thousand dinars in exchange for the services of “guarantor” and temporary residence. Lawyer Issam Al -Tayeb presented the prosecutor in the appeal, legal defenses and official documents, the most prominent of which was a letter issued by an agent The appealed company against it itself is approved by the amount of debt and displays an incomplete settlement, which the court considered an implicit declaration that proves the contractual relationship and the financial right. Al-Tayeb pointed out that the primary ruling “violated the constant with the papers and spoiled in the inferred”, and said that the hotel services company did not deny or explicitly deny the letter dated 11-8-2024, in which its agent approved the amount due, which enhances the document In proof according to the rules of Bahraini law, the original contract signed between the two parties was submitted, along with a number of signed, translated and displaced documents, which did not pay attention to the first degree court, which constituted a fundamental palaces in the primary ruling. Al -Tayeb pointed out that the denial submitted by the hotel services company did not include the aforementioned speech, but was limited to other documents, which is a silence that benefits the implicit declaration, which is What was confirmed by the Court of Appeal in the reasons for its ruling. The court ruled to cancel the previous ruling, and obligate the appealed company against it to pay the amount of 4140 dinars, in addition to the legal interest by 3% from the date of the case until the full payment, in addition to the lawsuit and law fees.
