According to what was stated in the ruling issued on June 25, 2025, the husband signed a photo sale contract that included a plot of 83 square meters in the Draz and two cars; One of them is Toyota Corolla, 1998 model, and the second Honda Accord model, and has a gold jewelry of 7000 dinars, in addition to cash amounts totaling 17250 dinars.
The sorcerer disappeared as soon as he received the property, which prompted the couple to resort to the criminal judiciary, where he was convicted in the Court of First Instance, and his partner was later convicted of the appeal after being acquitted in the first degree.
In the civil lawsuit, Lawyer Zahra Verdun called for the abolition of the actions that were carried out as a result of fraud, and the recovery of the market value of the land and vehicles, as well as compensation for psychological damage.
Although the court supported the occurrence of deception, it refused to nullify the contracts for the subsequent land, explaining that the new buyers acquired it in good faith, and that the sale was made with registered contracts, which prevents the return to them.
The court ruled that the defendant obliges the land to return the land at the amount of 79795 dinars, the two cars at 7500 dinars, and the amounts that were transferred electronically amounting to 1750 and 750 dinars, in addition to a joint compensation for the couple with 1,000 dinars for the moral damage.
Regarding the gold, the court saw that the spouses did not provide adequate description or evidence that proves its delivery, as well as refused to claim the price of the 2015 Lexus Model due to the lack of documents stating that it was owned by them or was purchased with their money.
The court also referred to medical reports that the husband has been receiving treatment since 2022 as a result of a mental disorder, but she did not take her in her evaluation of the ruling.
The court affirmed in the reasons for the ruling that it is not permissible to benefit the fraud, its actor in order to ward off corruption and in support of good faith and honor in transactions, and to pay off the courtyards to take a means of deviation or to be a ride to the Glor without right.
