Dar Al -Iftaa received a question from one of the followers whose text is: What is the ruling on the guidance of enjoyment if the agent performed the pilgrimage, in violation of what the principal ordered? Everyone has changed the pilgrimage from his deceased father without specifying the type of ihraam for him with the pilgrimage, so he had a pleasure: so whoever is the gift? Is the ruling differing if it is a condition that he must perform a unique pilgrimage, and a enjoyable pilgrimage, or to perform Hajj, so he committed to that?
What is the ruling on the guidance of enjoyment if the agent performs the pilgrim, enjoying contradictory to what the principal ordered?
And she said on her website: If every person entrusted others in the pilgrimage for his deceased father without being determined by the type of ihraam with Hajj, then a pilgrimage is enjoyable: if the guidance of enjoyment is obligatory for the agent, and also if he had to perform Hajj single, then he will be a pilgrimage, and he is enjoying, but if he had to perform Hajj, then he will be used. The client without the agent.
And she added: The agency or the prosecution is legally permissible, and it is the delegation of one person to another, while the prosecution is accepted; To do the condition of his life.
And she continued: And the condition entrusted to be the prosecution, so the power of attorney is not valid in physical worship except what is excluded, and from this the Hajj pilgrimage to the masses of scholars; It is a worship that is valid for the perpetrator on the authority of others that a person relies on the one who performs Hajj for it, or for others, or whoever sees him who does so.
