The government has reserved a parliamentary draft law to amend Article 9 of Decree Law No. 30 of 2009 regarding the Bahrain Chamber for the settlement of economic, financial and investment disputes, because the current law achieves its goal, and the draft law constitutes a burden on the Bahrain Chamber to settle disputes.
The amendment makes the quorum of the Chamber for its jurisdiction to separate the disputes that the jurisdiction is held in the first place to the courts of Bahrain or any body with a judicial jurisdiction when the value of the claim exceeds 100 thousand dinars instead of 500 thousand dinars, while the second executive article came related to the authorities entrusted with the implementation of the provisions of the proposed draft law, and the date of the start of the work with its provisions.
According to the deputies, the project aims to settle commercial and economic disputes quickly and fairly, and to open the way for a greater number of economic and financial disputes to be decided by the Bahrain Chamber to settle disputes, in a way that reflects positively on attracting more investments, which requires amending the value of the room’s value to become in the claims that exceed 100 thousand dinars instead of “500 thousand dinars”.
The government indicated that the existing legal organization will achieve the desired goal of the proposed law.
The government drew attention to the proposed bill may constitute a burden on the Bahrain Chamber for the settlement of disputes, as the proposed bill in the inclusion of the compulsory values quorum for the jurisdiction of the Chamber would overburden the room with a large number of claims more than what it is now, which may result in its inability to separate this amount of cases of the required speed and the same level of quality in its services. The curriculum has followed since its establishment, which contradicts the basic purpose of the creation of the room, and it also contradicts the goals envisaged by the draft law, which revolves around the speed of separation in cases in order to achieve the completed justice.
The government concluded that the draft law may negatively affect the quality of procedures and rulings, and thus influence the Chamber’s reputation and prestige acquired on the regional and international scene as a reliable global center to settle commercial and investment disputes, calling on the House of Representatives to review the proposed law.
