In a judicial precedent that sparked widespread controversy in Germany, the Bavarian Administrative Court in Munich issued a final and obligatory ruling to demolish a residential house in the state of Bavaria, whose roof exceeded the permitted height by only 36 centimeters, in a decision described by strict observers, despite the worsening crisis in the housing sector, according to the “Telegraph” newspaper.
Engineer Yans Ridege, 57, who is a tenant, expressed his deep shock from the ruling, which ended a 4 -year legal battle, between real estate developers and local authorities in the Wolfarathausen region, south of Munich.
Rydiger said in statements to the German newspaper “Bild” that the demolition decision is unreasonably, adding: “A residential place will be destroyed by millions of euros, only because the ceiling is higher than the allowed for 36 centimeters, and because a garage was built instead of the umbrella of cars, and the land was filled.”
Despite the severe shortage in the area in the housing units, the court confirmed that the violations that were marred by construction constitute “severe violations” of the laws of urban organization, including the establishment of violating slopes, walls with an unauthorized height, and a ceiling at an angle that is not compatible with the approved designs.
The court rejected previous offers from the developers to amend the construction and remedy the abuses, and the authorities also presented the idea of ​​converting the property into shelter for women, before it was later retracted.
For his part, a spokesman for the Wolfarathausen region office defended the decision, stressing that the large deviations from the organizational plan cannot be overlooked, whatever the circumstances.
According to local media, this house is one of 3 houses that have been destroyed by demolition orders in the same area, which reflects the increasing threat in the application of construction regulations within the German states.
Despite the cruelty of the ruling, the authorities granted the residents a deadline until the spring of 2026 to find a residential alternative, while Rediger confirmed that finding a 180 -meter -square -meter house with an acceptable rental value, will be a very difficult task.
This issue is due to the minds of similar incidents, most notably the ruling issued in 2014 by demolishing a house for a German retaging built in 1939 without an official license, during the chaos of the Second World War, before the authorities later retracted the decision after a long judicial battle that ended in favor of the lady.
