The Civil Supreme Court of Appeal rejected an appeal by a building buyer in Al -Hura at an amount of 3.5 million dinars, on the sale contract under the pretext of fraud on it and the concealment of violations on it, the hotel license lost it, and the court said in the reasons for the ruling that the appellant had renewed and transferred the license several times after purchasing the building, and had it not been for the failure to pay the license renewal fees at the time specified, no problem would have occurred in relation to the category of the building.
The lawsuit was filed by the buyer after 3 and a half years of his contract to purchase the hotel at a value of 3.5 million dinars, after editing a violation against him, the hotel license lost him, and that was due to his delay in paying the value of the renewal renewal during the legally allowed period, so he claimed a fraud in the sale contract, and he filed a lawsuit demanding that he be compensated, but the Civil Grand Court rejected his claim.
The buyer once again tried to appeal the ruling to appeal, as lawyer Zuhair Abdullatif, the hotel seller, confirmed that the sale was made in 2019, and the appellant received a tourist license certificate in the name of the hotel and approved this, in addition to what was stated in the documented sale contract that the sale was focused on the building, improvements, furniture, all installations and equipment in the property and furnishings, and the prosecutor examined it. In its condition, the sale contract did not include the hotel’s tourism license.
The appellant’s agent against him indicated that the buyer had applied for the renewal of the tourism license in 2023, and the request has reached the payment stage, but he did not pay the amount, and he is considered the first stage in requesting to provide the renewal of the tourist license, and the license ended in May of the same year, and according to the laws, the tourist activity owner is given a period of grace and opportunity for a period of 3 months to renew the license, but he did not pay the amount, and after the period of allowing the license becomes null In the event that he wants to practice tourism activity, the owner of the building requires a new application and fulfill all the requirements for this matter.
The court said in the reasons for the ruling that the requirements for renewing the license to apply for an official request to renew the tourism license through the system of the Bahrain Tourism and Exhibitions Authority fulfilling the established conditions and standards, and the validity of the commercial registry is validated, and 12 administrative violations have been monitored on the tourism registry various from 2016 until 2024 and referred to the Public Prosecution, but it did not lead to the removal or cancellation of the license.
The court confirmed, according to the representative of the Bahrain Tourism and Exhibitions Authority, that the reason for canceling the license is due to the failure to pay the fees at the time specified after more than 4 years of selling the hotel, and the appellant had renewed and transferred the tourism license several times after purchasing the building, and said that had it not been for the failure to pay the license renewal fees at the specified time, no problem would have occurred in relation to the category of the building, and the court ruled to refuse to appeal and obligate his expenses.
