It became clear after publishing an article on Sunday, “Medical Centers and Doctors without Work”, which deals with the paradox between the increasing number of private medical centers and the presence of unemployed Bahrainis, that there is legislation issued in 2019 “appealing” health institutions to grant priority to employing Bahrainis, including doctors, technicians or nurses.
And I chose the term “appeals”, and this is a special graduation that is not within the legal descriptions, but its reasons are that the legal text does not have a penalty in the event of a violation.
The amendment issued to this law:
Article (14) item (a) second paragraph:
The priority is to employ workers in private health institutions for doctors, technicians and Bahraini nurses who have the necessary qualifications and experience, and the jobs that require rare and unavailable specialized experience are excluded from that.
Article Two
The private health establishment must reconcile its conditions in accordance with the provisions of this law after the end of the contracts concluded with doctors, technicians and non -Bahraini nurses. “I finish”.
As you can see the formula has only obligatory, some say that there is a penalty but in the general law, and in the opinion of the Egyptian brothers, “I will be with me”, that is, who will discuss, and who is the one who complained? Why did the associations or even individuals move to the complaint?
What makes this law effective and binding, and it cannot be exceeded and easy to prove the violation of it?
The presence of the penalty or the punishment in the event of non -implementation, whether stipulated in the private law, or in the public law clearly without the gaps of the circumvention.
As for the most important of the existence of a text of the reward is a sincere intention for the government in following up the implementation of the law and providing the necessary measures to put it into practice, just as the evaders are pursued from paying the value -added tax !!
And that is controlled, and in the event of a violation by referring to the agencies concerned with the application of the law, any of these tools practiced by the government on private health institutions that violate this article? Have you heard any attempt to impose the second paragraph of item A?
They declare a vibrant apparent on the nationalities of their foreign medical staff without any reaction on our part.
Once again, we repeat that we are not against investing in the health sector, and we are not against the presence of foreign investors in this sector, and if I, as a country, I seek to attract this type of investment, and I offer it incentives, so that this will be within the scope of procedural facilities that are not disrupted and the provision of services, but I do not tolerate control over health controls, including the second paragraph in the amendment issued in 2019 in the priority of Bahraini.
Just as it is active in applying the procedures for the complaint of medical errors, it is most active in ensuring the application of this paragraph.
Perhaps it is necessary from Bahraini doctors who are applying to work in those institutions and they meet the conditions, yet their requests refuse to file a complaint to urge the government to implement this article in cooperation with the Association of Doctors and nurses.
In general, that paragraph, or that law alone, which was issued and was not implemented or applied, there are many legislations that have passed through many deliberations and amendments, and took time until it was issued, including laws that the government submitted such as the cleaning law, then our negligence in activating it and the reason for deficit, delay, negligence, or even confusion !!
I direct my invitation for the second time to limit these idle legislation and research into the causes of disruption, as this is the best thousand times of work on more of them, so the house of the disease is not to apply the penalty.
