Al -Watan monitored some active accounts in this field, and contacted one of them, which is “Abu Joury”, the owner of a licensed auction, announced in his Instagram account, and who listed his beginnings with the profession since the beginning of the Korona’s pandemic, which despite its disadvantages, but for him it was a light “Bab Rizk” and the project of his life that he is currently dependent on his income.

Abu Jauri said: It started 5 years ago, and when the “Heba” sale spread “Online” during the Korona pandemic; Because of the decisions of social divergence in that period, I found it an opportunity to enter the market by launching an auction for selling watches, bags, accessories, etc., and the beginning was an amount that did not exceed 80 dinars, to find a good profit in the project, then the decision of the Ministry of Industry and Trade was issued to organize auction work, so I applied to a commercial record, and opened a store two years ago, where the commercial registry allows the activity of the auction and public trade.

Al -Watan asked the Ministry of Industry and Trade on decisions and laws regulating auction work, and the ministry answered that Ministerial Resolution No. 10 of 2021 regarding the regulation of auctions has allowed the auctions allocated to sell goods or provide services to others through social networking sites, to apply for a license to carry out a commercial activity and called the activity of “selling for a price or return” or “on the basis of a contract” or “auctions” to the department concerned with the Ministry of Industry and Trade on The activity is compatible with the type of commodity to be presented, in addition to the necessity of displaying the commercial registry number on their accounts on the social media sites of the auction.

Temporary auctions does not exempt its owner from the license

In response to the question of “Al -Watan” regarding some “temporary” auctions or for a certain period of the day, in which some holdings are presented and sold without obtaining a license to do so, the ministry confirmed that the establishment of auctions temporarily or for a limited or continuous and regular period to display and sell some goods or services, those responsible for them are not relieved of commitment to Ministerial Resolution No. (10) of 2021 regarding the regulation of auctions. Where the decision stipulated that a license must be obtained to practice auction activity, whether it is through electronic means and platforms, or in certain headquarters, which regulates the process of practicing commercial activities in accordance with legal frameworks and requirements for commercial activity and ensuring the provision of a fair competitive environment, protecting customers, and preventing illegal practices, so establishing auctions without a license is a violation of the applicable systems, and displays those in charge of them Legal in accordance with Decree Law No. 27 of 2015 regarding the commercial registry, and the decisions issued in implementation of it.

Consumer protection in auction system

The “Industry and Trade” explained that in the process of protecting consumers and customers, it launched an integrated media awareness package and introduces those wishing to establish auctions with the requirements, licenses and activities required to practice such practices, in addition to raising awareness and educating individuals by dealing with official licenses of service and commodities through auctions by ensuring that they obtain the necessary licenses from the official authorities, and that To ensure their rights and avoid exposure to fraud, fraud, or the like.

Monitoring and tracking from the Inspection Department

The Ministry emphasized that the inspection department has a pivotal role in monitoring markets, electronic platforms and social media and monitoring and tracking electronic accounts that make auction, or declare regularly about goods and services, and verify them. When the violations are proven, the necessary legal measures and measures are taken in accordance with the laws and regulations in force in the ministry, as the ministry, in partnership and integration with the Department of Electronic Crime Combating the General Administration To combat corruption and economic and electronic security at the Ministry of Interior, in continuous coordination to deter violators and take appropriate measures and penalties, the Ministry also receives complaints and communications related to any violations or violations in this aspect, and is verified and dealt with according to what is followed in this regard. The Ministry stressed its constant keenness to educate consumers about the need to verify the identity of the sites on social media and not to deal with unlicensed unknown parties to avoid exposure to the monument.

Auctions that do not announce the licensing of “Al -Watan” monitored some of the auction account accounts “Online” did not put in its title whether they were licensed or not, as the newspaper contacted these accounts, but it did not receive answers about the presence of the license or not, which opens the way for the question about the legality of these auctions, where the number of followers reached more than 188 thousand followers, and the number of the pieces offered exceeded 15 thousand pieces, while another follower 24 A thousand followers, and on his account more than 100 pieces were offered for sale, which varied between hours, perfumes, women’s handbags, and others.
