The House of Representatives will resume its public session next Sunday, and the report of the Constitutional and Legislative Affairs Committee is scheduled to review on a draft law submitted by the government to amend some provisions of Law No. 93 of 2015 to establish some primary courts and amend the name and jurisdiction of some other primary courts.
Details of the draft law establishing some courts of first instance
The amendment submitted by the government stipulates that the name of the Assiut Court of First Instance will be replaced to the North Assiut Court of First Instance, wherever it is mentioned in this law or any other law, and this court is concerned with the departments (Assiut Center, Al -Fateh Center, the Abnoub Center, the Manfalut Center, the Qusiya Center, and the Dairout Center).
The South Assiut Court of First Instance is established, and is based in the city of Assiut, and specializes in the circles (the first section of Assiut, the second section of Assiut, the Abu Tig Center, the Sadfa Center, the Al -Ghanayem Center, the Selim Coast Center, and the Badari Center).
The amendment stipulated that the cases and requests pending before the departments of the Northern Assiut Court of First Instance and the South Assiut Court, which have become according to the provisions of this law, have become the jurisdiction of other departments, in their case unless they are reserved for the ruling, and those concerned are notified of the referral decision, and every ruling that violates the provisions of this law is canceled, provided that it works from the day following the date of its publication.
The draft law comes within the framework of the redistribution of jurisdiction between the northern and southern Asyut courts, and in the light of the administrative division of Assiut Governorate, and the cities and centers it covers, and in a way that contributes to bringing the jurisdiction of both courts to the residents of the province, in addition to the redistribution of issues to the circles of these two courts in a fair and balanced manner to achieve completed justice and ensure the speed of dismissal in issues and the elimination of the phenomenon of stacking issues in front of some circles, including It works to strengthen the Egyptian judicial system and ensure its effectiveness.
