The legal committee in charge of drafting the constitutional declaration in Syria reported today, Monday, that in light of the legal vacuum caused by the abolition of the 2012 constitution set by the Bashar al -Assad regime, it has become necessary to establish a constitutional declaration that regulates the transitional phase and directs the state towards stability and rebuilding, without being considered an alternative to the permanent constitution.
The committee said in a statement to the Syrian “SANA” news agency that “the constitutional declaration derives its legitimacy from the National Dialogue Conference and the Victory Conference, where the various components of the Syrian people agreed on the importance of the existence of a legal framework that regulates the transitional phase, determines the foundations of government and guarantees rights and freedoms. This legal document aims to manage the transitional phase in Syria, and determines the powers of the three authorities (legislative, executive and judicial).”
The committee affirmed that it will take responsibility for preparing the draft constitutional declaration after studying the principles and basic materials that must be included, in line with the interest of the country and the requirements of the transitional period. The committee was also keen to take advantage of the ideas that were circulated during the national dialogues and discussions that took place in the workshops for constitutional construction.
The committee pointed out that upon completion of the drafting of the announcement, the proposal will be submitted to the presidency of the Republic, in the context of a step aimed at establishing a new phase based on law and institutions, which ensures the transition towards Syria more stable and fair.
According to the sources, the President of the country is expected to appoint the People’s Assembly within 60 days from the date of issuing the constitutional declaration, provided that the council consists of 100 members who enjoy a fair representation of components and competencies, and the President of the Republic appoints them by a Republican decision, provided that the council’s duration is two years
