Dr. Nazir Ayyad, Mufti of the Republic, head of the General Secretariat of the role and advisory bodies in the world, stressed the importance of realizing the difference between Sharia and jurisprudence, considering that the confusion between them is one of the most dangerous things facing contemporary Islamic thought, and that this confusion may lead to intellectual and methodological deviations, ranging from stagnation and extremism on the one hand, and escaping and misfortune on the other hand.

He explained in televised statements that the Sharia is the divine approach that God has revealed to organize human life, and includes beliefs, acts of worship, transactions, ethics, and general legislation that achieve the major purposes of religion, which are fixed divine provisions derived from the book and the Sunnah, which cannot bear diligence or change, such as the necessity of prayer, the prohibition of killing unlawfully, and other peremptory rulings.

As for the jurisprudence, as the Mufti has shown, it is a science concerned with devising practical legal rulings from detailed evidence, and depends on the human jurisprudence disciplined with firm scientific principles, which leads to a diversity in jurisprudence opinions and a difference between doctrines, which is a Mahmoud difference, which reflects the flexibility of jurisprudence and its ability to interact with the variables of time and space.

Juristic renewal is a legal necessity

The Mufti pointed out that jurisprudence is not separate from the Sharia, but rather an understanding of it and an attempt to download it to reality, explaining that the law is infallible because it is from God, but jurisprudence is a human jurisprudence that is not infallible, which is subject to development and renewal in a way that achieves legitimate purposes and serves the interests of people.

The Mufti of the Republic warned of the results of the absence of discrimination between the two concepts, including stagnation and blind imitation, and the name of renewal, militancy and rejection of ijtihad, which leads to the disruption of Islamic thought, and produces a distorted religious discourse, either rigid or wicked, and both do not express the truth of Islam, stressing that the need is urgent today to renew jurisprudence within the framework of the law In a recent, citing the saying of Imam Al -Shatby: “The law is based on achieving interests and staving off evil, so what was achieving the interest of the nation is from religion, even if he did not want a specific text in it.”

The Mufti concluded his speech by calling to adhere to the principles of Sharia, and support enlightened jurisprudence who is able to confront the developments of the times, asking God Almighty to provide the nation the light of insight and jurisprudence in religion, and to prepare for it from scholars and reformers who renews the matter of its religion and achieves its purposes in its reality.
